L’entreprise individuelle Hélène Petry désigne un organisme de formation, dont le siège social est situé au 15 montée Sainte Appolonie, 06610, La Gaude, France. L’activité de formation est enregistrée sous le n° 93060894206 auprès du préfet de région PACA. Cet enregistrement ne vaut pas agrément de l’Etat. Hélène Petry met en place et dispense des actions de formation intra-entreprises et pour particuliers dans les Alpes Maritimes et sur l’ensemble du territoire national, seule ou en partenariat.
Hélène Petry est membre de l'Association des Formateurs Indépendants, organisme de formation certifié Qualiopi.
Objet et champ d’application
Les présentes Conditions Générales de Vente déterminent les conditions applicables aux prestations de formation effectuées par Hélène Petry pour le compte d’un client. Toute commande de formation auprès de la société implique l'acceptation sans réserve du client des présentes Conditions Générales de Vente. Ces conditions prévalent sur tout autre document du client, en particulier sur toutes conditions générales d’achat.
Devis et attestation
Pour chaque formation, Hélène Petry s’engage à fournir un devis au client. Ce dernier est tenu de retourner à la société un exemplaire renseigné, daté, signé et tamponné, avec la mention « Bon pour accord ».
Prix et modalités de paiement
Les prix des formations sont indiqués en euros et sont exonérés de la TVA en accord avec l’Art. 261.4.4 du CGI. Le paiement est à effectuer à la commande de la formation à réception de la facture, au comptant, par virement bancaire sur le compte:

La commande de la formation n’est considérée effective qu’à réception du paiement. En l’attente de paiement de la part du client, Hélène Petry se réserve le droit de modifier les dates de formation proposées.
Prise en charge
Si le client bénéficie d’un financement par un Opérateur de Compétences (OPCO), il doit faire une demande de prise en charge à la commande de la prestation. Le contrat de formation sera alors réalisé auprès de l’Association des Formateurs Indépendants (AFI), organisme certifié Qualiopi dont Hélène Petry est membre, et des frais de dossier de 20% du financement seront applicables.
Conditions de report et d’annulation d’une séance de formation
Le report d’une séance de formation est possible, à condition d’en faire la demande au moins 15 jours calendaires avant la date de formation prévue. Tout report doit faire l’objet d’une notification par e-mail à l’adresse contact@helenepetry.com
En cas de report demandé moins de 15 jours calendaires avant la date de la formation, le client est tenu de payer une pénalité, à hauteur de 20% du coût total initial de la formation.
En cas d’annulation de la formation au moins 30 jours calendaires avant la date prévue, et de demande de remboursement de la part du client, des frais d’annulation de 30% du coût initial total seront applicables. Entre 29 et 15 jours calendaires avant la date de formation, ces frais s’élèveront à 50%. Entre 14 et 3 jours calendaires, ces frais s’élèveront à 80%. En cas d’annulation moins de 48h avant la date de formation, aucun remboursement ne sera effectué.
En cas d’inexécution de ses obligations suite à un événement fortuit ou à un cas de force majeur, Hélène Petry ne pourra être tenue responsable à l’égard de ses clients. Ces derniers seront informés par e-mail et/ou par téléphone. Une nouvelle date de formation sera fixée avec l'accord du client, ou la formation intégralement remboursée.
Programme des formations
Si elle le juge nécessaire, Hélène Petry pourra modifier les contenus des formations suivant la problématique du client, la dynamique de groupe ou le niveau des participants. Les contenus des programmes figurant sur les fiches de présentation ne sont ainsi fournis qu’à titre indicatif.
Une fois la formation réalisée par l'apprenant, une attestation de formation lui sera fournie.
Propriété intellectuelle et droit d’auteur
Les supports de formation de une ou deux pages (roue des émotions et des besoins, mémo…) peuvent être reproduits et partagés librement sous condition d’attribution écrite à l’auteur sur le support partagé.
Les supports de formation de plus de deux pages (cahiers d’exercices, fiches pédagogiques…) sous soumis au droit d’auteur. Leur reproduction, partielle ou totale, ne peut être effectuée sans l’accord exprès d’Hélène Pétry. Le client s’engage à ne pas utiliser, transmettre ou reproduire tout ou partie de ces documents en vue de l’organisation ou de l’animation de formations.
Informatique et libertés
Les informations à caractère personnel communiquées par le client à Hélène Petry sont utiles pour le traitement de l’inscription ainsi que pour la constitution d’un fichier clientèle pour des prospections commerciales. Suivant la loi « informatique et libertés » du 6 janvier 1978, le client dispose d’un droit d’accès, de rectification et d’opposition des données personnelles le concernant.
Loi applicable et attribution de compétence
Les présentes Conditions Générales de Vente sont encadrées par la loi française. En cas de litige survenant entre Hélène Petry et le client, la recherche d’une solution à l’amiable sera privilégiée, y compris par recours à une médiation. À défaut, l’affaire sera portée devant les tribunaux de Grasse.

Designation
The sole trader Hélène Petry is a training organisation whose head office is located at 15 montée Sainte Appolonie, 06610, La Gaude, France. The training activity is registered under no. 93060894206 with the Prefect of the PACA region. Hélène Petry organises and delivers in-company and private training courses in the Alpes Maritimes and throughout France, either alone or in partnership.
Hélène Petry is a member of the Association des Formateurs Indépendants, a Qualiopi-certified training organisation.
Purpose and scope of application
The present General Terms and Conditions of Sale determine the conditions applicable to training services provided by Hélène Petry on behalf of a client. Any training order placed with the company implies the customer's unreserved acceptance of these General Terms and Conditions of Sale. These conditions prevail over any other document of the customer, in particular over any general conditions of purchase.
Quotation
For each training course, Hélène Petry undertakes to provide the Customer with a quotation. The latter is required to return to the company a copy that has been filled in, dated, signed and stamped with the words ‘Good for agreement’.
Prices and payment terms
Training prices are quoted in euros and are exempt from VAT in accordance with Art. 261.4.4 of the General Tax Code. Payment must be made when the course is ordered, on receipt of the invoice, in cash, by bank transfer to the following account:

The training order is not considered effective until payment has been received. Hélène Petry reserves the right to modify the proposed training dates pending payment by the client.
Financing
If the customer is eligible for funding from a Skills Operator (OPCO), he/she must submit a request for funding when ordering the service. The training contract will then be drawn up with the Association des Formateurs Indépendants (AFI), a Qualiopi-certified organisation of which Hélène Petry is a member, and a handling fee of 20% of the funding will apply.
Conditions for postponing and cancelling a training session
Postponement of a training session is possible, provided that the request is made at least 15 calendar days before the scheduled training date. Any postponement must be notified by e-mail to (email provided)
In the event of a postponement requested less than 15 calendar days before the training date, the customer is required to pay a penalty of 20% of the total initial cost of the training.
If the course is cancelled at least 30 calendar days before the scheduled date and the customer requests a refund, a cancellation fee of 30% of the total initial cost will apply. Between 29 and 15 calendar days before the course date, this charge will be 50%. Between 14 and 3 calendar days before the training date, this charge will be 80%. In the event of cancellation less than 48 hours before the training date, no refund will be made.
Hélène Petry shall not be held liable to its clients in the event of non-performance of its obligations as a result of a fortuitous event or force majeure. Clients will be informed by e-mail and/or telephone. A new training date will be set with the client's agreement, or the training will be reimbursed in full.
Training programme
If she deems it necessary, Hélène Petry may modify the content of the training courses according to the customer's problems, the group dynamics or the level of the participants. The contents of the programmes shown on the presentation sheets are provided for information purposes only.
Once the learner has completed the course, a training certificate will be provided.
Intellectual property and copyright
Training materials of one or two pages in length (wheel of emotions and needs, memo, etc.) may be freely reproduced and shared provided that the author is given written attribution on the shared material.
Training materials longer than two pages (workbooks, teaching sheets, etc.) are subject to copyright. They may not be reproduced in whole or in part without the express permission of Hélène Pétry. The customer undertakes not to use, transmit or reproduce all or part of these documents with a view to organising or running training courses.
Information technology and civil liberties
The personal information communicated by the customer to Hélène Petry is used for the processing of the registration as well as for the constitution of a customer file for commercial prospecting.In accordance with the French Data Protection Act of 6 January 1978, customers have the right to access, rectify and object to any personal data concerning them.
Applicable law and jurisdiction
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute between Hélène Petry and the Customer, the search for an amicable solution will be preferred, including recourse to mediation. Failing this, the case will be brought before the courts of Grasse.
